# VALTSTORAGE TERMS OF SERVICE

## 1. INTRODUCTION AND ACCEPTANCE OF TERMS

1.1 **Application of Terms.** These Terms of Service (hereinafter referred to as the "Terms," "Agreement," or "ToS") constitute a legally binding agreement between you (hereinafter referred to as "User," "You," "Your," or "Yourself") and Valtstorage (hereinafter referred to as "Valtstorage," "We," "Us," "Our," or the "Service Provider"), governing your access to and use of the Valtstorage platform, services, applications, and associated technologies (collectively, the "Service").

1.2 **Acceptance Mechanism.** By accessing, registering for, or using the Service in any capacity or manner whatsoever, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any provision contained herein, you must immediately discontinue access to and use of the Service.

1.3 **Capacity to Contract.** You represent and warrant that you possess the legal capacity to enter into this binding Agreement. If you are accessing or using the Service on behalf of a business entity, organization, or other legal entity, you further represent and warrant that you are authorized to bind such entity to these Terms.

1.4 **Modification of Terms.** Valtstorage reserves the right, at its sole and absolute discretion, to modify, amend, supplement, or replace these Terms at any time without prior notification. Any such modifications shall become effective immediately upon posting of the updated Terms on the Valtstorage website or platform. Your continued use of the Service following the posting of modified Terms constitutes your acceptance of and agreement to be bound by such modifications. It is your responsibility to regularly check these Terms for any modifications.

## 2. DESCRIPTION OF SERVICE

2.1 **Service Overview.** Valtstorage provides decentralized digital storage solutions with end-to-end encryption technologies. Our platform utilizes advanced cryptographic protocols and distributed ledger technology to fragment, encrypt, and distribute digital data across a decentralized network of storage nodes.

2.2 **Service Functionality.** The Service enables Users to:
   (a) Upload digital content to a decentralized storage network;
   (b) Encrypt such content using advanced cryptographic algorithms;
   (c) Access such content via decryption keys maintained solely by the User;
   (d) Share encrypted content with third parties through secure mechanisms; and
   (e) Utilize various complementary features as may be introduced from time to time.

2.3 **Technical Architecture.** The Service operates on principles of:
   (a) Zero-knowledge architecture, whereby Valtstorage lacks the technical capability to access, view, decrypt, or otherwise interpret User content;
   (b) Distributed storage, whereby User content is fragmented and distributed across multiple independent storage nodes;
   (c) End-to-end encryption, whereby User content is encrypted before transmission from the User's device; and
   (d) Cryptographic verification, whereby content integrity is maintained and verified through distributed ledger technologies.

2.4 **Service Limitations.** User acknowledges and accepts that the Service:
   (a) May not be available in all jurisdictions;
   (b) May experience temporary outages, disruptions, or technical limitations;
   (c) May evolve to include or exclude features at Valtstorage's discretion;
   (d) Is provided on an "as is" and "as available" basis without warranties of any kind; and
   (e) Is subject to the inherent limitations of decentralized technology architectures.

2.5 **Access Requirements.** Access to and use of the Service requires:
   (a) A compatible device with adequate processing capabilities;
   (b) A stable internet connection with sufficient bandwidth;
   (c) A supported web browser or application with current security protocols;
   (d) Compliance with any additional technical requirements as may be specified from time to time; and
   (e) Acceptance of cookies, APIs, and other technologies necessary for Service functionality.

## 3. USER RESPONSIBILITIES AND CONDUCT

3.1 **Content Responsibility.** You are solely, exclusively, and entirely responsible for:
   (a) All content uploaded, stored, shared, transmitted, or otherwise processed through the Service ("User Content");
   (b) Maintaining appropriate backups of User Content independent of the Service;
   (c) The legality, appropriateness, and compliance of User Content with applicable standards;
   (d) Any consequences arising from the access to or use of User Content by third parties; and
   (e) All activities occurring under your account or through your access credentials.

3.2 **Encryption Management.** You acknowledge and accept full responsibility for:
   (a) Safeguarding all encryption keys, passwords, recovery phrases, and access credentials;
   (b) Implementing appropriate security measures to prevent unauthorized access to your encryption keys;
   (c) Understanding that loss of encryption keys will result in permanent inaccessibility of encrypted User Content; and
   (d) Recognizing that Valtstorage lacks the technical capability to recover, reset, or bypass your encryption keys under any circumstances.

3.3 **Prohibited Activities.** Without prejudice to the principle of User autonomy, you acknowledge understanding that certain activities may carry legal, financial, reputational, or technical consequences for which you bear sole responsibility. Such activities include but are not limited to:
   (a) Attempting to circumvent, disable, or interfere with the Service's security features;
   (b) Attempting to gain unauthorized access to other Users' accounts or private information;
   (c) Attempting to disrupt, damage, or impair the functionality of the Service or its infrastructure;
   (d) Using automated systems, bots, scrapers, or crawlers to access the Service unless explicitly permitted;
   (e) Engaging in any action that imposes an unreasonable load on the Service's infrastructure; and
   (f) Reverse engineering, decompiling, or otherwise attempting to derive source code from the Service.

3.4 **User Content Practices.** You understand that:
   (a) Valtstorage does not pre-screen User Content and cannot technically access the content of your encrypted files;
   (b) Valtstorage respects the principle of freedom of speech and User autonomy in the decentralized ecosystem;
   (c) You are responsible for ensuring your use aligns with your own ethical standards and risk tolerance;
   (d) The decentralized nature of the network means that complete deletion of all distributed copies of User Content cannot be guaranteed; and
   (e) Content transmitted through the Service may be subject to varying legal interpretations across different jurisdictions.

3.5 **Account Security.** You are responsible for:
   (a) Maintaining the confidentiality of your account information and credentials;
   (b) Restricting access to your device when connected to the Service;
   (c) Implementing appropriate security measures such as strong passwords and two-factor authentication when available;
   (d) Promptly notifying Valtstorage of any suspected unauthorized access to your account; and
   (e) All activities that occur under your account, whether or not authorized by you.

3.6 **Communication Responsibilities.** You agree to:
   (a) Provide accurate contact information as may be requested;
   (b) Promptly update such information in the event of any changes;
   (c) Accept Service-related communications, including security alerts and administrative messages; and
   (d) Acknowledge that such communications shall not be considered unsolicited commercial messages.

## 4. INTELLECTUAL PROPERTY

4.1 **Service Ownership.** The Service, including without limitation its underlying technology, software, algorithms, cryptographic protocols, user interface designs, visual interfaces, interactive features, graphics, compilations of data, and all other elements of the Service (collectively, "Service Elements"), is owned by Valtstorage and is protected by copyright, trademark, patent, trade secret, and other intellectual property and proprietary rights laws.

4.2 **Limited License Grant.** Subject to your compliance with these Terms, Valtstorage grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for its intended purposes. This license does not include the right to:
   (a) Modify, adapt, or create derivative works based on the Service Elements;
   (b) Copy, reproduce, distribute, display, or perform the Service Elements;
   (c) Remove, obscure, or alter any proprietary notices or labels on the Service Elements;
   (d) Use the Service Elements for commercial purposes unless explicitly authorized; or
   (e) Transfer your rights to access or use the Service to any third party.

4.3 **User Content Ownership.** You retain all ownership rights in User Content. By uploading, storing, or sharing User Content through the Service, you grant Valtstorage a limited, non-exclusive, royalty-free license to use, transmit, and store User Content solely as necessary to provide and maintain the Service, subject to the encryption and privacy protocols inherent in the Service.

4.4 **Feedback License.** If you provide Valtstorage with any suggestions, recommendations, or feedback regarding the Service (collectively, "Feedback"), you grant Valtstorage a perpetual, irrevocable, non-exclusive, royalty-free right to use, implement, and commercialize such Feedback in any manner and for any purpose, without attribution or compensation to you.

4.5 **Third-Party Intellectual Property.** The Service may incorporate or interact with third-party software, APIs, content, or other materials that are licensed under third-party terms. Your use of such third-party materials may be subject to additional terms and conditions.

4.6 **Copyright Infringement.** Despite Valtstorage's technical inability to monitor or control User Content, Valtstorage respects the intellectual property rights of others. If you believe your intellectual property has been used in a way that constitutes infringement, please be aware that due to the encrypted nature of User Content, Valtstorage's ability to address such claims is severely limited by the technical architecture of the Service.

## 5. PRIVACY AND DATA PROTECTION

5.1 **Privacy Policy.** Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. The Privacy Policy explains our practices regarding the collection, use, and disclosure of information in connection with the Service.

5.2 **Zero-Knowledge Architecture.** You acknowledge and understand that:
   (a) Valtstorage operates on a zero-knowledge architecture whereby all User Content is encrypted on your device prior to transmission;
   (b) Valtstorage does not possess the technical capability to access, view, decrypt, or otherwise interpret the contents of encrypted User Content;
   (c) Valtstorage cannot monitor User Content for compliance with any laws, regulations, or policies; and
   (d) Valtstorage cannot perform content moderation on encrypted User Content.

5.3 **Metadata and Technical Data.** Notwithstanding the zero-knowledge architecture, you acknowledge that Valtstorage may collect and process certain non-content data, including:
   (a) Technical metadata necessary for Service functionality (e.g., file sizes, timestamps);
   (b) Usage statistics in aggregated, anonymized form;
   (c) Error reports and performance data;
   (d) Account credentials and encryption keys that you explicitly provide; and
   (e) Other technical information necessary for the provision and improvement of the Service.

5.4 **Government Requests.** Valtstorage adheres to principles of user privacy and data sovereignty. In the event of any governmental or legal request for User Content or information:
   (a) Valtstorage will promptly notify you of such request unless legally prohibited from doing so;
   (b) Valtstorage will, to the extent legally permissible, challenge overly broad or inappropriate requests;
   (c) Valtstorage will only provide information that is technically accessible to Valtstorage, which explicitly excludes decrypted User Content; and
   (d) Valtstorage lacks the technical capability to decrypt User Content and therefore cannot provide decrypted User Content in response to any request, regardless of its legal validity.

5.5 **Data Residency.** Due to the distributed nature of the Service:
   (a) Fragments of encrypted User Content may be stored across multiple jurisdictions;
   (b) The location of specific fragments is algorithmically determined and may change over time;
   (c) Valtstorage cannot guarantee that User Content will be stored in any specific jurisdiction; and
   (d) You acknowledge that cross-border data transfers may occur as part of the normal operation of the Service.

## 6. DISCLAIMER OF WARRANTIES

6.1 **Service Provided "As Is."** THE SERVICE, INCLUDING ALL CONTENT, FUNCTIONS, AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH THE SERVICE, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATIONS, WARRANTIES, GUARANTEES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, CURRENCY, OR TIMELINESS OF THE SERVICE.

6.2 **Operational Limitations.** VALTSTORAGE DOES NOT WARRANT THAT:
   (a) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE;
   (b) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS;
   (c) DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED;
   (d) THE SERVICE OR THE SERVERS THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
   (e) ALL DISTRIBUTED COPIES OF USER CONTENT CAN BE COMPLETELY DELETED ACROSS THE ENTIRE DECENTRALIZED NETWORK; OR
   (f) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, CURRENT, OR MEET YOUR EXPECTATIONS.

6.3 **Technical Limitations.** YOU EXPRESSLY ACKNOWLEDGE AND ACCEPT THAT:
   (a) DECENTRALIZED TECHNOLOGIES ARE EXPERIMENTAL AND INVOLVE INHERENT RISKS;
   (b) THE CRYPTOGRAPHIC AND DISTRIBUTED STORAGE TECHNOLOGIES EMPLOYED BY THE SERVICE MAY CONTAIN UNKNOWN VULNERABILITIES;
   (c) THE SERVICE MAY EXPERIENCE DOWNTIME, REDUCED FUNCTIONALITY, OR OTHER LIMITATIONS DUE TO TECHNICAL CONSTRAINTS, NETWORK CONGESTION, OR OTHER FACTORS BEYOND VALTSTORAGE'S CONTROL;
   (d) COMPLETE DATA RECOVERY CANNOT BE GUARANTEED IN THE EVENT OF CATASTROPHIC TECHNICAL FAILURES; AND
   (e) FUTURE TECHNOLOGICAL DEVELOPMENTS MAY COMPROMISE THE SECURITY MEASURES CURRENTLY EMPLOYED BY THE SERVICE.

6.4 **Reliance on Service.** YOU UNDERSTAND AND AGREE THAT ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL.

6.5 **Legal Compliance.** YOU UNDERSTAND THAT VALTSTORAGE MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE LEGALITY OF THE SERVICE IN ANY PARTICULAR JURISDICTION OR THE COMPLIANCE OF THE SERVICE WITH ANY PARTICULAR LAW OR REGULATION. IT IS YOUR RESPONSIBILITY TO ENSURE THAT YOUR USE OF THE SERVICE COMPLIES WITH LAWS APPLICABLE TO YOU.

## 7. LIMITATION OF LIABILITY

7.1 **Direct Damages.** TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VALTSTORAGE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT DAMAGES IN EXCESS OF THE AMOUNT PAID BY YOU TO VALTSTORAGE FOR USE OF THE SERVICE DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE DATE OF THE CLAIM, OR ONE HUNDRED DOLLARS (USD $100) IF NO SUCH PAYMENT HAS BEEN MADE.

7.2 **Excluded Damages.** TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VALTSTORAGE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, LOSS OF BUSINESS OPPORTUNITY, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF VALTSTORAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.3 **Specific Exclusions.** WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, VALTSTORAGE SPECIFICALLY DISCLAIMS ANY LIABILITY FOR:
   (a) ACTIONS RESULTING FROM YOUR USE OF THE SERVICE;
   (b) LOSS OR UNAUTHORIZED ACCESS TO USER CONTENT DUE TO LOST OR COMPROMISED ENCRYPTION KEYS;
   (c) FAILURE TO STORE, RETRIEVE, OR DELETE USER CONTENT;
   (d) USER CONTENT OR CONDUCT OF ANY THIRD PARTY;
   (e) ANY UNAUTHORIZED ACCESS TO, USE OF, OR ALTERATION OF YOUR TRANSMISSIONS OR USER CONTENT;
   (f) ANY THREATS, DEFAMATION, OBSCENITY, OR OFFENSIVE OR ILLEGAL CONDUCT OF ANY THIRD PARTY;
   (g) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY;
   (h) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND
   (i) LOSS OF ENCRYPTION KEYS, PASSWORDS, OR RECOVERY PHRASES RESULTING IN PERMANENT INABILITY TO ACCESS USER CONTENT.

7.4 **Basis of Bargain.** THE LIMITATIONS OF LIABILITY IN THESE TERMS SHALL APPLY WHETHER THE ALLEGED LIABILITY OR LOSSES ARE BASED ON CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF VALTSTORAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

7.5 **Essential Purpose.** THE LIMITATIONS SPECIFIED IN THIS SECTION WILL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. THE LIMITATIONS OF LIABILITY PROVIDED IN THESE TERMS INURE TO THE BENEFIT OF VALTSTORAGE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS.

## 8. INDEMNIFICATION

8.1 **Indemnification Obligation.** You agree to defend, indemnify, and hold harmless Valtstorage, its affiliates, directors, employees, agents, contractors, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
   (a) Your use of and access to the Service;
   (b) Your User Content;
   (c) Your violation of any term of these Terms;
   (d) Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; or
   (e) Any claim that your User Content or use of the Service caused damage to a third party.

8.2 **Defense Obligation.** You agree to cooperate as reasonably required in the defense of any claim. Valtstorage reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with Valtstorage's defense of such claim.

## 9. USER AUTONOMY AND FREEDOM

9.1 **Decentralized Philosophy.** Valtstorage operates under principles of:
   (a) User autonomy and technological freedom;
   (b) Decentralization and distribution of control;
   (c) Privacy by design and zero-knowledge architecture; and
   (d) Resistance to centralized control or interference.

9.2 **Freedom of Expression.** Valtstorage respects and supports Users' freedom of expression and the free flow of information. We believe in:
   (a) The right of Users to store and share content without censorship or prior restraint;
   (b) The inherent value of privacy and confidentiality in digital communications;
   (c) The principle that technological capabilities should enhance rather than diminish individual freedoms; and
   (d) The importance of User sovereignty over their own digital content.

9.3 **Jurisdictional Independence.** Valtstorage's decentralized architecture is designed to:
   (a) Operate independently of traditional jurisdictional boundaries;
   (b) Distribute encrypted User Content across multiple independent nodes;
   (c) Minimize centralized control points that could be leveraged to compromise User privacy; and
   (d) Resist attempts to impose restrictions that undermine the core principles of the Service.

9.4 **User Choice.** Users of the Service retain full agency to:
   (a) Determine the nature and content of data stored through the Service;
   (b) Control access to their encrypted content through management of encryption keys;
   (c) Choose when and how to share their content with third parties; and
   (d) Request deletion of their content, with the understanding of the technical limitations inherent in distributed systems.

## 10. DATA DELETION AND RETENTION

10.1 **Deletion Requests.** Upon your request, Valtstorage will make reasonable efforts to delete User Content from active systems. However, you acknowledge and understand that:
   (a) Due to the distributed nature of the Service, complete deletion of all copies of User Content from all distributed nodes cannot be technically guaranteed;
   (b) Residual fragments of encrypted User Content may persist in backup systems, distributed nodes, or system logs;
   (c) The decentralized architecture means that some nodes may be temporarily offline during deletion attempts; and
   (d) Technical limitations may prevent absolute verification that all copies have been deleted.

10.2 **Data Retention.** Valtstorage retains certain limited technical data related to the Service, which may include:
   (a) Anonymized access logs for system security and performance monitoring;
   (b) Aggregate usage statistics for Service improvement;
   (c) Account identifiers and public key information as necessary for Service functionality; and
   (d) Payment transaction records as required for financial record-keeping.

10.3 **Abandonment Protocol.** In cases where accounts remain inactive for extended periods, Valtstorage may implement abandonment protocols that:
   (a) Permanently deactivate dormant accounts after a significant period of inactivity;
   (b) Attempt to notify Users prior to account deactivation;
   (c) Execute deletion procedures for User Content associated with abandoned accounts; and
   (d) Retain minimal records of deactivated accounts solely for security and record-keeping purposes.

## 11. DISPUTE RESOLUTION

11.1 **Initial Dispute Resolution.** Valtstorage values its relationship with Users and seeks to address concerns without resorting to formal legal proceedings. Before filing a claim against Valtstorage, you agree to attempt to resolve the dispute informally by contacting Valtstorage. Similarly, Valtstorage will make reasonable efforts to contact you to resolve any dispute informally before initiating any formal proceedings.

11.2 **Decentralized Dispute Resolution.** In alignment with our decentralized philosophy, Valtstorage may offer optional decentralized dispute resolution mechanisms that:
   (a) Operate independently of traditional legal systems;
   (b) Utilize consensual arbitration by neutral third parties;
   (c) Apply logical reasoning rather than specific national legal frameworks; and
   (d) Emphasize mutually acceptable outcomes based on technological realities and Service principles.

11.3 **Time Limitation on Claims.** You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

## 12. GENERAL PROVISIONS

12.1 **Entire Agreement.** These Terms (including the Privacy Policy incorporated by reference) constitute the entire agreement between you and Valtstorage regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the Service.

12.2 **Severability.** If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permissible under law, except where such enforcement would fundamentally alter the nature of these Terms.

12.3 **No Waiver.** The failure of Valtstorage to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

12.4 **Assignment.** You may not assign or transfer these Terms, or any rights or obligations hereunder, without the prior written consent of Valtstorage. Any attempted assignment or transfer without such consent will be null and void. Valtstorage may assign or transfer these Terms, in whole or in part, without restriction.

12.5 **Force Majeure.** Valtstorage shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay results from any cause beyond Valtstorage's reasonable control, including but not limited to: acts of God; flood, fire, earthquake, pandemic, epidemic, or explosion; war, invasion, hostilities, terrorist threats or acts, riot or other civil unrest; governmental order, law, or actions; embargoes or blockades; strikes, labor stoppages or slowdowns, or other industrial disturbances; network, telecommunications, power, or systems failure; or shortage of adequate power or telecommunications or transportation facilities.

12.7 **No Third-Party Beneficiaries.** These Terms do not and are not intended to confer any rights or remedies upon any person other than you and Valtstorage.

12.8 **Export Control.** You may not use, export, re-export, import, or transfer the Service except as authorized by applicable laws, including without limitation the export control laws of your jurisdiction of residence.

12.9 **Survival.** All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
